Terms of use

1 Definitions

In this document, the following terms have the meanings set out next to them unless the context requires otherwise:

• “The platform” or “the service”: The Kwntum platform and all tools, interfaces, and features it provides to create and run online stores, orders, payments, shipping, and related functions.
• “The user” or “you”: Any natural or legal person who accesses, registers on, or uses the platform in any way.
• “The store”: The online store the user creates and manages through the platform.
• “Content”: Everything published or entered on the platform or in the store: text, images, data, offers, products, and descriptions.
• “Related policies”: The privacy policy, cookie policy, and any other policies or guidelines we publish and refer to in the service.

2 Acceptance of the terms

Accessing or using Kwntum in any way (browsing, signing up, creating a store, managing orders, paying, or otherwise) means you accept these terms and related policies (including the privacy policy). If you do not agree, please do not use the service.

If you registered or created a store, continued use after any change to the terms is acceptance of the updated version. We recommend reviewing this page periodically.

3 Service description and scope

Kwntum provides SaaS tools to create and run online stores, including without limitation: store templates, dashboard, product and order management, payment and shipping integrations, reports, and support according to the published plans.

The service is provided “as is” with the capabilities available today. We improve the platform continuously and do not commit to specific results or uninterrupted availability. We may change, suspend, or stop features for operational, security, or legal reasons, with notice when possible.

The platform is a technical intermediary between the store owner and their customers. We are not a party to sale contracts between you and your customers, and we are not responsible for performing those contracts or for the quality of goods and services you offer through your store.

4 Eligibility, registration, and account

You must be legally able to enter binding contracts. If you are under the legal age in your country, you must use the service with a parent or legal guardian’s consent. If you register on behalf of a legal entity (company or organization), you confirm you are authorized to bind it to these terms.

When you register, you must provide accurate, complete, and up-to-date information. You are responsible for keeping your login details (email and password) confidential and for all activity under your account. Notify us immediately of any unauthorized use or suspected breach.

We may refuse registration or suspend or terminate an account if the information provided is false or violates the terms or the law.

5 Acceptable and prohibited use

You agree to use the platform and store only for lawful purposes that comply with these terms, applicable laws, and public morals.

The following is prohibited, including without limitation:

• Using the service for fraud, cheating, impersonation, or deception.
• Selling or promoting products or services that are illegal or that infringe others’ rights (counterfeits, piracy, dangerous or banned products).
• Sending spam, unsolicited messages, or malware.
• Attempting to hack, disrupt, or harm the platform, its systems, or its users.
• Scraping data or content automatically without permission, or misusing APIs if available.

If any of this is violated, we may suspend or terminate your account and store immediately without prior notice when needed, while reserving any legal remedies.

6 Content and responsibility

You are fully responsible for the content you publish or enter in your store (products, images, text, offers, prices, and your own return policies). You must have the rights or license to use and publish that content, and it must not infringe others’ rights or the law.

We do not pre-review store content and are not responsible for it. We may still remove or hide content we believe violates the terms, the law, or our policies, without a duty to give prior notice. We cooperate with competent authorities when legally required.

By using the service, you grant us a non-exclusive, sublicensable license to use, display, store, and transmit the content you provide solely to provide, improve, and operate the platform.

7 Subscriptions, payments, and billing

Some features or plans may require a paid subscription. Prices, billing, and terms are shown at signup or in the dashboard. You must pay on time and follow the approved payment policies (card, transfer, or other).

Prices may change. If we raise prices for active subscriptions, we will notify you a reasonable time before the change, and the new prices apply to the next billing cycle. Continuing after the notice means you accept the new price.

You are responsible for VAT or any other local taxes that apply to your use of the service under the laws of your country.

8 Refunds and cancellation

Refund and cancellation policies for subscriptions are published on the subscription page or in emails sent at signup. If there is no explicit text, we are not obligated to refund amounts paid for periods already used.

If you cancel a subscription or close your account, you are not entitled to a refund for the remaining period unless the refund policy shown at signup says otherwise.

9 Intellectual property

All platform rights (software, design, logo, the “Kwntum” trade name, interfaces, database, and equivalents) are reserved to us or our licensors. You may not copy, modify, resell, or create derivative works without prior written consent.

Content you create in your store remains yours. We do not claim ownership of that content, while the license above remains for operating the service.

10 Limitation of liability and warranty

The service is provided “as is” and “as available”. To the extent permitted by law, we exclude implied warranties such as fitness for a particular purpose or non-infringement.

We are not liable for indirect, consequential, special, or punitive damages, including lost profits, data, reputation, or opportunities, arising from use of the service, unavailability, errors, outages, or changes we make. Our total liability to you for any claim related to the service will not exceed the amount you paid us in the twelve months before the claim (or an equivalent amount if the service is free).

Nothing above affects your mandatory legal rights that cannot be excluded or limited.

11 Ending the service and deleting the account

You may close your account anytime from account settings or by contacting us. When the account ends, we may delete or keep your data according to the privacy policy and the law.

We may suspend or terminate your account (and store) immediately, with or without prior notice, if these terms are violated or for operational, security, or legal reasons. When possible we will tell you the reason if that is not unlawful.

After the account ends, provisions that by nature should survive (such as definitions, limitation of liability, and governing law) remain in effect.

12 Changes to the terms

We may amend these terms from time to time. We will publish the updated version on this page with a “Last updated” date. We recommend reviewing the page periodically.

Continuing to use the service after changes take effect means you accept the updated terms. If you do not agree, you may close your account and stop using the service before they take effect.

13 Governing law and dispute resolution

These terms, their interpretation, and their enforcement are governed by the applicable law of the Kingdom of Saudi Arabia (or the country where the platform is operated, if different), without prejudice to conflict-of-law rules.

Any dispute arising from these terms or the service should first be resolved amicably. If that is not possible, the dispute shall be submitted to the competent courts in the Kingdom of Saudi Arabia (or the country specified above), unless the law provides otherwise.
